These Terms and Conditions (“Terms”) are published in compliance with the provisions of the Information Technology Act, 2000, the rules framed thereunder, and any other applicable laws in force in India. The Terms are intended to govern the access and use of the website, online booking system, and related services provided by Ballderma Clinic (“Ballderma” or “the Clinic”) by any person who visits the website, books an appointment, or avails services offered by the Clinic (“User” or “Patient”). By using the website or by booking an appointment, the User acknowledges that they have read, understood, and agreed to be bound by these Terms in their entirety.
The Clinic provides an online interface designed solely to enable Users to book appointments with qualified dermatologists and skin care specialists at Ballderma, and to provide general information regarding the services available at the Clinic. The User expressly agrees that the website shall not, under any circumstances, be used for fraudulent, misleading, or unlawful purposes. Users are required to provide accurate, complete, and truthful details including their name, email address, and mobile number when making a booking. The Clinic shall not be liable for any delay, loss, or inconvenience arising out of the provision of false or inaccurate information by the User, and reserves the right to cancel any appointment or deny services where such false information has been provided.
The information available on the website of the Clinic is intended solely for general awareness and educational purposes. While the Clinic endeavours to provide accurate and updated content regarding dermatological treatments, aesthetic procedures, and related services, such information shall not be construed as professional medical advice or relied upon for purposes of self-diagnosis or self-treatment. The User expressly acknowledges that every treatment offered at the Clinic is subject to prior medical evaluation, and that final suitability shall be determined solely by the qualified dermatologist or authorised medical staff of the Clinic at the time of consultation. The Clinic does not, under any circumstances, guarantee uniform or assured results, as outcomes of medical and aesthetic procedures naturally vary between individuals depending on skin type, medical history, age, and other physiological factors.
Appointment bookings made by the User shall be confirmed through the contact details provided at the time of booking. All appointments are strictly subject to availability of the concerned doctor and operational circumstances of the Clinic. The Clinic reserves the absolute right to reschedule, modify, or cancel an appointment due to unavoidable circumstances including, but not limited to, the unavailability of medical staff, technical issues, or force majeure events. Users are requested to arrive at the Clinic on time for their appointments, failing which the Clinic reserves the right to reduce the consultation time or reschedule the appointment at its discretion.
While the Clinic endeavours to ensure that the website is accessible at all times, it does not warrant uninterrupted access and shall not be liable for downtime, connectivity issues, or technical errors beyond its control. Further, the Clinic makes no representation regarding the accuracy, completeness, or reliability of third-party links or external resources that may be displayed on or accessible through its website. Any reliance on such third-party content shall be entirely at the User’s risk.
The Clinic, its doctors, staff, and representatives shall not be liable for any indirect, incidental, consequential, or exemplary damages that may arise from the use of its website or services, including but not limited to errors in content, appointment delays, technical failures, or the outcomes of medical treatment. The liability of the Clinic, if any, shall at all times be limited to the value of the consultation fee paid by the User at the Clinic for the specific appointment in dispute, subject always to the exclusions and limitations permitted under Indian law.
The website, including all text, graphics, designs, logos, and other content, is the sole and exclusive property of Ballderma and is protected under the provisions of the Copyright Act, 1957 and other applicable intellectual property laws of India. The User is expressly prohibited from reproducing, duplicating, copying, distributing, modifying, or otherwise using such content for commercial purposes without the prior written consent of the Clinic. Any unauthorised use shall constitute a violation of intellectual property rights and may give rise to civil or criminal liability under applicable law.
Users are prohibited from engaging in any activity that may compromise the security of the website, including attempting to gain unauthorised access, introducing viruses or malware, disrupting network systems, or interfering with the normal functioning of the site. The Clinic reserves the right to suspend or terminate access to Users found engaging in such unlawful activities, in addition to pursuing appropriate legal remedies.

These Terms and Conditions shall be governed by, and construed in accordance with, the laws of India. Any disputes, claims, or proceedings arising out of or relating to the use of the website, the booking of appointments, or the delivery of services by the Clinic shall be subject to the exclusive jurisdiction of the competent courts located at Mumbai, Maharashtra.
